Kung Fu Tea Loyalty Program Terms & Conditions

These Loyalty Program Terms & Conditions (“Loyalty Terms”) govern participation in the Kung Fu Tea Loyalty Program (the “Program”), offered by KF Tea Franchising LLC, doing business as Kung Fu Tea (“Kung Fu Tea,” “we,” “us,” or “our”). By enrolling in, accessing, or participating in the Program, you (“Member,” “you,” or “your”) agree to be bound by these Loyalty Terms, which are in addition to our Terms & Conditions and Privacy Policy. In the event of any conflict, these Loyalty Terms will govern matters specifically relating to the Program.
If you do not agree to these Loyalty Terms, you must not enroll in or participate in the Program.
1. Eligibility
- The Program is open only to individuals who are at least 13 years of age and reside in the United States.
- By enrolling, you represent and warrant that you meet these requirements.
- The Program is intended for personal, non-commercial use only. Businesses, groups, associations, and other entities are not eligible to participate.
2. Enrollment
- Membership in the Program is free.
- To enroll, you must create a Loyalty Program account using the Kung Fu Tea App, website, or other designated enrollment method.
- You must provide accurate, complete, and current information during registration and update it as needed.
- You are responsible for maintaining the confidentiality of your account credentials (including your phone number and any login details) and for all activities under your account.
3. Earning Points
- Members earn reward points (“Points” or “Bubbles”) on qualifying purchases made through the Kung Fu Tea App, Online Ordering, or in-store at participating locations.
- To earn Points for in-store purchases, you must scan your registered Kung Fu Tea App QR code or enter your registered phone number at the point of sale before completing payment.
- If you do not link your Loyalty Program account at the time of purchase, your order will not be associated with your account and Points cannot be credited retroactively.
- Points accrual rates, eligible products, and promotional multipliers may vary by location and are subject to change without notice.
4. Redeeming Points
- Points may be redeemed for eligible menu items, discounts, or other rewards as described in the Kung Fu Tea App or on our website.
- Redemption options, thresholds, and availability are determined by Kung Fu Tea and may change, be substituted, or discontinued without prior notice.
- Points have no cash value, are not property, and are non-transferable and non-assignable. Points cannot be exchanged for cash, credit, or any other value, except where required by law.
- Once redeemed, Points will be deducted from your account and cannot be reinstated.
5. Point Expiration and Adjustment
- Points may expire if not redeemed within the timeframe specified in the App, website, or Program materials.
- Kung Fu Tea may adjust, revoke, or withhold Points if they were awarded in error, earned through fraudulent activity, or linked to canceled, refunded, or reversed transactions.
- KF Tea Franchising LLC’s determination of your Point balance is final and binding.
6. Loyalty Program Misuse
Members are strictly prohibited from engaging in fraudulent or abusive behavior, including but not limited to:
- Using another customer’s transaction or account without authorization to accrue Points or rewards.
- Entering your own Loyalty Program information (e.g., phone number or QR code) during transactions in which you were not a participant.
- Creating duplicate or multiple accounts for the same individual.
- Attempting to manipulate or circumvent Program rules, systems, or restrictions.
Consequences of Misuse:
- Immediate suspension or termination of your Loyalty Program account.
- Forfeiture of all accrued Points and rewards.
- Recovery of any benefits improperly obtained.
- Possible legal action or other remedies as permitted by law.
7. Program Changes and Termination
- Right to Modify or End the Program: Kung Fu Tea may, in its sole discretion, modify, suspend, or terminate the Program, these Loyalty Terms, the Points system, or any related benefits at any time, for any reason, with or without prior notice.
- Notice of Changes: When we make changes to these Loyalty Terms, we will update the “Effective Date” at the top of this page. We may also provide notice of material changes by posting an update in the App, on our website, or through other reasonable means.
- Effect of Changes: Your continued participation in the Program after any changes are posted constitutes your acceptance of the revised Loyalty Terms. If you do not agree, you must stop participating in the Program.
- Termination: If the Program is terminated, all unredeemed Points or rewards will automatically expire and have no value. Kung Fu Tea will not be liable for any such expiration or loss.
8. Privacy
Participation in the Program is subject to our Privacy Policy, which explains how we collect, use, and share your personal information.
9. Limitation of Liability
- To the fullest extent permitted by law, Kung Fu Tea and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, consequential, or special damages, or for any lost profits, revenues, or data, arising out of or related to the Program.
- In no event will Kung Fu Tea’s total liability to you in connection with the Program exceed the value of the Points you have accumulated at the time of the claim.
10. Governing Law
These Loyalty Terms and your participation in the Program are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law rules.

12. Notice of Clarification
These Loyalty Terms were originally effective as of January 23, 2024. On September 4, 2025, we updated this document to provide additional clarity about how Points are earned for in-store purchases. Specifically, the Terms clarify that Members must scan their registered Kung Fu Tea App QR code or enter their registered phone number before completing payment in order to earn Points. This requirement has been in place since the Program’s launch, and the update simply makes the rule clearer in writing.
